1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and HuntFishSport ("we," "us," or "our") governing your access to and use of the HuntFishSport website, mobile applications, and services (collectively, the "Service") located at huntfishsport.com.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

HuntFishSport provides solunar theory-based predictions, weather forecasts, and location management tools to help hunters and anglers determine optimal times for outdoor activities. Our Service includes:

  • Free Tier: Basic solunar data, current weather, up to 2 saved locations, basic features

  • Pro Tier: Advanced features including Best Day Finder, Double Drop Detector, Multi-Location Comparison, Thermal Scout, Super-Peak Windows, Terrain Analysis, up to 25 saved locations, 14-day weather forecasts, and historical weather data

3. Account Registration and Responsibilities

3.1 Account Creation

To access certain features, you must create an account by providing accurate and complete information including your name, email address, and password. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activities that occur under your account. You agree to:

  • Use a strong password and keep it secure

  • Not share your account credentials with others

  • Notify us immediately of any unauthorized access or security breach

  • Accept responsibility for all activities conducted through your account

3.3 Accurate Information

You agree to provide accurate, current, and complete information and to update it as necessary to maintain its accuracy. We reserve the right to suspend or terminate accounts with false or misleading information.

4. Subscription Terms (Pro Tier)

4.1 Subscription Plans

Pro subscriptions are available on a monthly or annual basis. Pricing is displayed on our pricing page and may be changed with 30 days' notice. Current subscribers will receive advance notice of price changes.

4.2 Billing and Payment

Subscriptions are billed in advance on a recurring basis. By subscribing, you authorize us to charge your payment method on file. Payment processing is handled securely by Stripe, and we do not store your complete credit card information.

You are responsible for:

  • Maintaining valid payment information

  • Paying all applicable taxes

  • Ensuring sufficient funds for recurring charges

  • All charges incurred under your account

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the then-current subscription rate. You can cancel automatic renewal at any time through your account settings or Stripe Customer Portal.

4.4 Cancellation

You may cancel your subscription at any time through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the end of the paid period. No partial refunds are provided for mid-period cancellations.

4.5 Failed Payments

If a payment fails, we will attempt to charge your payment method again. If payment continues to fail, your subscription may be suspended or cancelled. You are responsible for resolving payment issues promptly.

4.6 Refund Policy

We offer a 7-day money-back guarantee for first-time Pro subscriptions. To request a refund within 7 days of initial purchase, contact us at [email protected]. Refunds are not available for:

  • Subscription renewals

  • Mid-period cancellations

  • Accounts terminated for violation of these Terms

Refunds are processed within 10 business days to the original payment method.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable laws or regulations

  • Infringe on intellectual property rights of others

  • Transmit malware, viruses, or harmful code

  • Attempt to gain unauthorized access to our systems or other users' accounts

  • Use automated scripts or bots to access the Service (except official API usage with valid tokens)

  • Reverse engineer, decompile, or disassemble any part of the Service

  • Remove or modify any copyright, trademark, or proprietary notices

  • Sell, resell, or commercially exploit the Service without written permission

  • Share your Pro subscription with others

  • Create multiple accounts to circumvent service limitations

  • Abuse rate limits or attempt to overwhelm our systems

  • Use the Service for any illegal hunting or fishing activities

6. Intellectual Property Rights

6.1 Our Content

The Service and its entire contents, features, and functionality (including but not limited to text, graphics, logos, icons, images, software, and the arrangement thereof) are owned by HuntFishSport or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use.

6.3 Third-Party Content

The Service incorporates data from third-party sources.

You agree to comply with all applicable third-party licenses and terms.

6.4 User Content

You retain ownership of any content you submit to the Service (e.g., saved locations, preferences). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display such content solely for providing the Service.

7. Disclaimers and Limitations

7.1 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may suspend, modify, or discontinue any part of the Service at any time with or without notice.

7.2 Accuracy of Information

IMPORTANT: Solunar predictions, weather forecasts, and other information provided by the Service are for informational purposes only. While we strive for accuracy, we do not guarantee the accuracy, completeness, or reliability of any information.

You acknowledge that:

  • Solunar theory is not scientifically proven and predictions are theoretical

  • Weather forecasts may be inaccurate or outdated

  • Real-world conditions may differ from predictions

  • You should always check local conditions, regulations, and safety guidelines

  • The Service is not a substitute for professional judgment or local knowledge

7.3 "AS IS" and "AS AVAILABLE"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

7.4 Third-Party Services

The Service relies on third-party services (weather APIs, location databases, payment processing) that may experience outages or failures. We are not responsible for the availability, accuracy, or performance of third-party services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUNTFISHSPORT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data

  • Loss of opportunity or business interruption

  • Personal injury or property damage

  • Unsuccessful hunting or fishing trips

  • Reliance on inaccurate predictions or forecasts

ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless HuntFishSport and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of the Service

  • Your violation of these Terms

  • Your violation of any rights of another person or entity

  • Any content you submit to the Service

10. Term and Termination

10.1 Term

These Terms remain in effect while you use the Service.

10.2 Termination by You

You may terminate your account at any time through your account settings or by contacting [email protected]. Cancellation of Pro subscriptions follows the cancellation policy in Section 4.4.

10.3 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service immediately, without notice or liability, for any reason, including but not limited to:

  • Violation of these Terms

  • Fraudulent, abusive, or illegal activity

  • Failure to pay subscription fees

  • Prolonged inactivity (180+ days)

  • At our sole discretion for operational or legal reasons

10.4 Effect of Termination

Upon termination:

  • Your right to access the Service immediately ceases

  • We may delete your account data after 30 days

  • Subscription fees are non-refundable except as stated in Section 4.6

  • Provisions that by their nature should survive termination remain in effect

11. Dispute Resolution

11.1 Informal Resolution

Before filing a formal dispute, please contact us at [email protected] to attempt informal resolution. Most disputes can be resolved quickly and amicably.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.

11.3 Venue

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in the State of Minnesota. You consent to the personal jurisdiction of such courts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Updating the "Last Updated" date at the top of this page

  • Posting a notice on our website for 30 days

  • Sending an email notification (for significant changes)

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and HuntFishSport regarding the Service and supersede all prior agreements.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any affiliate or successor without restriction.

13.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.
